Terms of service

1. Seller identification

The website svador.com is operated by GRUPO JYNS GARCIA S.L., which sells its products under the SVADOR brand.

  • Spanish tax identification number (NIF): B22523443.
  • Registered office: Parque Mestre Ferrero, number 15, door 6, 46870 Ontinyent, Valencia, Spain.
  • Email: hello@svador.com.
  • Telephone and WhatsApp: +34 614 385 642.

In these terms, “SVADOR” and “we” refer to GRUPO JYNS GARCIA S.L.

2. Purpose and scope

These terms govern the use of our online shop and purchases made by consumers through svador.com.

The product information, offer conditions and details displayed before you confirm your order form part of the purchase, together with these terms and our Returns and Refunds Policy.

The processing of personal data is explained in our Privacy Policy. Accepting the purchase terms does not constitute consent to receive advertising or to the use of cookies that require consent.

3. Legal capacity and customer details

You must have legal capacity to enter into a contract to make a purchase. If you are a minor and lack that capacity, your legal representative must act on your behalf.

The contact, billing and delivery details you provide must be accurate and up to date. If you notice an error after placing an order, contact us as soon as possible so we can help correct it.

When using a customer account, protect your login details and notify us if you suspect unauthorised access. You will not automatically be held responsible for every fraudulent use of your account.

These terms apply to consumer purchases. For distribution or professional resale, please contact SVADOR beforehand.

4. Product information

Each product page specifies its characteristics, such as model, materials, colour, sizes and price.

Photographs aim to represent products accurately. Screen settings may cause slight differences in perceived colour; this does not entitle us to deliver a product different from the description.

Natural materials may show variations in texture or finish consistent with their nature. This does not exclude SVADOR's liability for defects or differences from advertised characteristics.

Size guides help you choose the fit, although this may vary depending on foot shape and model. You can consult us before purchasing.

We may update the catalogue or discontinue products. These changes will not unilaterally alter the agreed characteristics of orders already placed.

5. Ordering process

To place an order:

  1. Select the products and their variants.
  2. Add them to your cart.
  3. Enter the details required for delivery and billing.
  4. Review the items, quantities, address, shipping and total price.
  5. Select an available payment method and confirm the purchase using the corresponding button, which entails an obligation to pay.

Before confirming, you can review and correct the details entered.

You will receive an email confirming and summarising your order. If it does not arrive, check your spam folder or contact us before placing the order again.

We retain order records in accordance with our legal obligations. You can request information about your purchase or a copy of its documentation by emailing hello@svador.com.

You can save or print these terms. The contract is concluded in the available language you select during checkout.

6. Prices, taxes and promotions

The applicable price is the price displayed when you make the purchase and stated in its confirmation.

Consumer prices include the taxes applicable to the sale according to the destination. Shipping costs and any other amount charged by the shop will be displayed before you confirm the order.

If a destination is subject to import taxes, customs clearance or other charges that we cannot collect at checkout, we will inform you beforehand of this and who must pay them. SVADOR will not apply additional charges that have not been disclosed and accepted.

Promotions and discount codes are subject to their advertised conditions, such as dates, eligible products and compatibility with other discounts. Their application will be reflected before payment.

We may change prices for future purchases. Changes will not affect orders already placed or reduce the rights associated with them.

Prices and promotions on our website may differ from those offered by physical shops or independent retailers.

7. Payment and invoicing

You may use the payment methods enabled at checkout. You must be authorised to use the chosen method.

If payment is not completed or is declined, we will inform you when that information becomes available to us. We may request reasonable checks where there are signs of fraud, without requiring unnecessary data.

If you notice a duplicate or incorrect charge, contact us so we can review it.

You can request an invoice by providing the necessary billing details. Electronic invoices will be issued with your consent where required; you may request a paper invoice free of charge.

8. Availability and order issues

If we discover that stock is unavailable or another circumstance prevents us from fulfilling your order, we will inform you and refund the relevant amounts if we cannot fulfil it.

We may offer an alternative, but we will not replace a product or increase the purchase amount without your agreement.

We will correct information errors we identify on the website. If an error affects an order already placed, we will contact you to resolve it in accordance with applicable law. An error does not give us a general right to cancel orders arbitrarily.

9. Shipping and delivery

Available destinations and shipping options are displayed during checkout. Further details are provided in our Shipping Policy.

We only accept orders for delivery to enabled destinations. A country appearing in a language or currency selector does not in itself mean that shipping is available there.

We will deliver your order within the agreed time. If no other delivery time has been agreed, delivery will take place without undue delay and no later than 30 calendar days after the contract is concluded.

If there is a delay, contact us. Where applicable, you may allow us a reasonable additional period and terminate the purchase if delivery still does not take place. No additional period is required in cases provided for by law, such as refusal to deliver or failure to meet an essential date communicated before purchase.

Where SVADOR arranges transport, the risk of loss or damage remains with us until you, or a person you designate other than the carrier, physically receive the products.

10. Cancellations, returns and exchanges

The full conditions and the withdrawal form are available in our Returns and Refunds Policy.

You may notify us of your withdrawal from your online purchase within 14 calendar days of receipt, without giving a reason. For separate deliveries within the same order, the period starts when you receive the last product.

You may notify us by email, WhatsApp or post. Prior authorisation is not required, and WhatsApp is not the only permitted channel.

Our commercial benefits are:

  • Orders delivered in Spain: the first return and first size exchange per order are free using transport arranged by SVADOR, including enabled Spanish island destinations.
  • Orders delivered outside Spain: the customer pays return shipping for returns. For the first size exchange, the customer pays return shipping and SVADOR pays to send the new pair to the original destination.
  • Subsequent transactions: the costs and conditions detailed in the Returns and Refunds Policy apply.

The first free return and first free exchange in Spain are independent benefits.

Size exchanges are subject to availability. If there is no stock, you will not be required to accept a voucher.

If you wish to cancel an order, contact us as soon as possible. If it has not yet been prepared, we will cancel it free of charge. If it has already been prepared or shipped, we will try to stop it; if this is not possible, it will be handled under our returns policy without restricting your right of withdrawal.

Costs for voluntary returns do not apply to remedies we must provide for defective products or errors by SVADOR.

11. Statutory guarantee and product conformity

New products carry a three-year statutory guarantee against lack of conformity from delivery, without prejudice to other applicable mandatory rules.

If you receive a defective, damaged or incorrect product, contact hello@svador.com and provide the order details and a description of the issue.

The remedies provided by law will apply, free of charge where applicable. Details are set out in our Returns and Refunds Policy.

No reference to material variations, photographs, availability or third-party tools excludes the statutory product guarantee.

12. Use of the website

You must use the website lawfully and respect other people's rights.

Impersonation, introducing malicious software, attempting to access other people's accounts, interfering with the shop's operation or bypassing its security measures are prohibited.

We may take proportionate measures to protect the service against fraud or unlawful use. Restricting access to an account does not extinguish rights arising from previous purchases, including delivery, returns, guarantees and complaints.

13. Intellectual property

The website's texts, photographs, videos, designs, logos and other content belong to SVADOR or their respective owners, or are used with the appropriate authorisation.

You may browse the website and save information needed to assess or document your purchases. Other uses are subject to the relevant authorisation and statutory exceptions.

These terms do not transfer ownership of trademarks or other intellectual property rights to you.

14. Reviews and user content

If you publish a review, it must reflect your experience and respect other people's rights. Do not include third-party personal data without authorisation or fraudulent, threatening or unlawful content.

By submitting content for publication in the shop, you authorise its reproduction and display in that context, including necessary technical adaptations without changing its meaning.

Use of personal images or testimonials in advertising campaigns requires the appropriate permissions. Publishing a review does not constitute unlimited permission for any use of your image.

We will not remove reviews solely because they are negative. We may moderate unlawful, fraudulent or irrelevant content, or content that infringes rights, using objective criteria.

15. Shopify and third-party services

Our shop uses Shopify's technology platform. Purchases on svador.com are made with GRUPO JYNS GARCIA S.L., which is the seller and your point of contact for orders.

Shopify and other providers may be involved in hosting, payments or other shop functions. Their involvement does not reduce SVADOR's obligations as seller or exclude each provider's statutory responsibilities.

Links to external websites may be subject to their respective owners' terms and policies. This does not limit our responsibility for services we engage to fulfil your purchase.

16. Privacy

We process personal data in accordance with our Privacy Policy, which explains the purposes, legal bases, recipients and rights of data subjects.

Data required to manage a purchase will not be used for other purposes without the appropriate legal basis.

Accepting these terms does not replace any specific consent that may be required.

17. Liability

SVADOR is responsible for fulfilling its obligations under applicable law.

We work to keep the shop available and its information up to date. If a technical issue affects an order or payment, contact us so we can resolve it.

These terms do not exclude liability that cannot legally be limited, nor do they impose a general obligation on the customer to bear SVADOR's or its providers' losses, claims or defence costs.

18. Customer service and complaints

You can contact us by email at hello@svador.com, by telephone or WhatsApp on +34 614 385 642, or by post at the address in section 1.

We will respond to complaints within a maximum of 15 calendar days of receipt.

If we cannot reach a resolution, you may contact public consumer bodies, use applicable dispute resolution mechanisms and bring proceedings before the competent courts.

19. Governing law and competent courts

These terms are governed by Spanish law.

If you habitually reside in another country, this choice does not deprive you of the protection of mandatory provisions applicable to you.

Any dispute will be submitted to the courts competent under applicable law, without requiring you to waive your rights as a consumer.

20. Updates and interpretation

We may update these terms for future purchases. Each order is governed by the version applicable when it was placed and by the conditions of the accepted offer.

An update will not retrospectively change your orders or require you to accept new terms to exercise rights already acquired.

If any clause is invalid or unenforceable, it will be treated as not included and the remaining clauses will remain effective where the contract can continue. No provision will be interpreted to reduce consumers' non-waivable rights.
